Terms of Service Agreement

Welcome to DropStart (the "App"), a Shopify app developed by Bizamatics LLC ("we", "us", "our"). By installing and using our App, you ("User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not install or use the App.
- Acceptance of Terms
By installing and using the App, you agree to these Terms and all other operating rules, policies, and procedures that may be published from time to time on the Shopify App Store or directly by us. We reserve the right to update or change these Terms at any time, and your continued use of the App signifies your acceptance of any revised Terms.
- Description of the App
DropStart provides a step-by-step process and automated mechanism for Merchants to either 1) sign up for a Shopify store using a DropStart Client’s affiliate referral link or 2) use their existing store and then receive content such as themes, images, pages, products, and settings from the Client for the purpose of saving time and effort in the setup of their store.
- User Responsibilities
- You must be a Shopify store owner or have permission from the store owner to use the App, or become a Shopify store owner by using the App to create a store.
- You agree to use the App only for lawful purposes and in accordance with these Terms.
- You are responsible for maintaining the confidentiality of your Shopify store credentials and for all activities that occur under your account.
- License
We grant you a limited, non-exclusive, non-transferable license to access and use the App for your personal or internal business purposes, subject to these Terms.
- Fees and Payment
- A one-time processing fee of up to $500 USD may apply.
- The specific amount you are required to pay will be clearly displayed within the App before you enter payment information. If you choose to pay the fee, you agree that you have done so on a purely voluntary basis and with full comprehension of the amount of the one-time fee.
- Refer to the Shopify Payments legal documentation for additional information.
- There will be no refunds given for any DropStart fees or charges except in the case of accidental overcharges. All sales are final.
- Cancellation and Termination
- We reserve the right to terminate or suspend your access to the App for any reason, including but not limited to breach of these Terms, at our sole discretion.
- Intellectual Property
- All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of Bizamatics LLC or its Clients or licensors and are protected by intellectual property laws.
- You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the App without our prior written consent.
- You may not attempt to reverse engineer DropStart or create or modify an app to be similar in function or likeness to DropStart.
- Data Privacy
- We are committed to protecting your privacy. Please review our Privacy Policy to understand how we collect, use, and safeguard your information.
- Disclaimers / Limitation of Liability
- To the fullest extent permitted by law, Bizamatics LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our App by any third party; (iv) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the App; (v) or your use of this App or your Shopify store for any unlawful or malicious purposes.
- DropStart has been approved for use with the Shopify platform but has not been created or endorsed by Shopify. Additionally, DropStart is not part of the Facebook website or Facebook Inc. DropStart is not endorsed by Facebook in any way. Facebook is a trademark of FACEBOOK, Inc.
- By making a purchase, you are acknowledging that you are receiving a prebuilt store(s) design from a DropStart Client, which means multiple Customers could receive the same or similar design. These are helpful ideas for a store design but should not be considered an operational business, and there is NO guarantee of income to be generated because of your DropStart purchase. If charged a fee by DropStart, you are simply paying for DropStart to upload the Client’s design and/or product selection to your store. You can build your own store for free at Shopify.com.
- If you create a store using DropStart, the Client and/or DropStart may earn a commission from Shopify.
- Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Washington and other applicable jurisdictions, without regard to its conflict of law provisions.
